Commercial Lease Dispute: Obligation of Continuous Operation

Following the receipt by the owner of a shopping center of a notice of termination of lease prior to the end of the term, which was sent by a supermarket occupying a rentable area of more than 45,000 sq. ft., Me Alexandre Béchard of Gascon and Associates obtained for the client, in the fall of 2021, the issuance of a Safeguard Order ordering the tenant to continue to occupy the leased premises and to operate its supermarket on a continuous basis.

 

Following the issuance of this order, the parties settled their commercial dispute out of court.
