Governing law
This Website is governed by the laws in force in the Province of Québec, Canada, and is subject to the application of these laws, without giving effect to any conflict-of-law principles. Any user who chooses to access this Website from another country does so on his own initiative and is responsible for complying with local laws. Accordingly, the courts of the Province of Québec, Canada, in the City of Montréal shall have exclusive jurisdiction over any suit, action or proceeding arising out of or in connection with this Website. You hereby irrevocably acknowledge the exclusive competence of these courts with respect to any dispute. PRIVACY AND ACCESS TO INFORMATION
When it comes to the protection of personal information, Gascon is subject to the provisions of the ACT RESPECTING THE PROTECTION OF PERSONAL INFORMATION IN THE PRIVATE SECTOR (CQLR c.P-39.1) (the “Act“), which were amended in September 2022.
Gascon is currently working on the development of a policy on the protection of personal information, and it will be published on our website and social networks soon.
Information collected and its use
Gascon collects miscellaneous personal information through its website using log files, cookies and web beacons. The information gathered includes Internet Protocol (IP) addresses, browser types, Internet Service Providers (ISP), dates and time, referring/exit pages and possibly the number of clicks, visitor preferences and the pages of the website the visitor has accessed or visited. The content gathered is not linked to any personally identifiable information and is used to optimize the user experience by customizing the content of the site based on the visitor’s type of browser or other information. Gascon also has a “Careers” section, through which a visitor can provide various personal information, including a curriculum vitae, and any relevant additional documents they may decide to attach.
As part of its commitment to its clients, Gascon gathers a variety of personal information, which is necessary for the execution of mandates and does so in compliance with our ethical rules. Such information includes surnames, given names, postal and email addresses, telephone numbers, job titles, financial information and bank details, credit card numbers, other identification and verification information such as copies of passports, driver’s licences and information obtained under the mandates entrusted to us, as well as data from public bodies.
All information collected by Gascon, if any, remains strictly confidential and will not be communicated, sold, rented or lent out, without having obtained the consent of the persons concerned, except in cases where the Law allows it.
Gascon may use third-party suppliers to manage certain aspects of its business, including the processing of data relating to its mandates and its technological services. These mandated third parties may have access to personal information when it is necessary for the performance of their contract. They are bound by the same confidentiality obligations and must protect personal information held in accordance with the Act.
Consent
Gascon makes sure to inform its clients of the purposes for which personal information is collected, used and disclosed. By providing personal information to Gascon, you authorize us to collect, use, disclose and retain such personal information as authorized or required by law.
You may refuse or withdraw your consent at any time by contacting the person responsible for privacy and access to information. We reserve the right to refuse certain requests in accordance with applicable laws. Please note that withdrawing your consent may force us to terminate our service and prevent us from providing you with the required legal services and advice.
Access to Information Request
Upon request, individuals have the right to be informed of the existence, use and disclosure of their personal information. The person concerned also has the right to consult the information that Gascon holds about them, subject to the exceptions provided for by the applicable legislation. Upon request, the individual may obtain a list of the organizations or third parties to which their personal information has been or may have been disclosed to. Said individual may also contest the accuracy and completeness of their personal information and request that Gascon make the appropriate corrections as soon as possible, when the person concerned has demonstrated that the information is inaccurate or incomplete.
To exercise their rights, the individual to whom the personal information pertains to must send a written request to aiprp@gascon.ca or by mail to the attention of Ms. Karine Blais, Executive Director of Gascon. The procedure to follow will then be provided. Any request will result in a verification of the identity and their eligibility to assert these rights.
